Terms & Conditions

Important: These Terms & Conditions govern product sales only made through the JOS Studios website (the “Site”). We do not sell or provide salon services or membership plans on this Site. Any prior references to services or memberships do not apply.

1) Acceptance of Terms
By accessing the Site, placing an order, or otherwise purchasing a product from JOS Studios (“JOS Studios,” “we,” “us,” “our”), you agree to be bound by these Terms & Conditions, our Privacy Policy, and any policies referenced here (e.g., Shipping Policy, Return Policy). If you do not agree, please do not use the Site.
 
2) Eligibility
You must be the age of majority in your province/territory or country of residence, or have consent from a legal guardian, to make purchases on the Site.
 
3) Account & Information Accuracy
You agree to provide current, complete, and accurate information for all purchases and to promptly update details such as email, shipping address, and payment information so we can complete your transaction and contact you as needed.
 
4) Product Information & Availability
We strive to display products, images, ingredients, and colors accurately. Actual packaging and colors may vary due to device settings or manufacturing updates. Product availability is not guaranteed; we may limit quantities, discontinue items, or cancel orders at our discretion.
 
5) Pricing, Taxes & Currency
Prices are listed in the currency shown at checkout (typically CAD) and may change without notice. Applicable taxes (e.g., HST/GST/PST) and shipping charges are calculated at checkout. We reserve the right to correct pricing errors and cancel any order arising from such errors.
 
6) Orders & Acceptance
Order confirmation acknowledges receipt of your order; it is not acceptance. We may refuse or cancel an order for reasons including product limitations, suspected fraud, unusual ordering activity (e.g., reseller quantities), or payment issues. If we cancel, we will refund any amount charged for the canceled items.
 
7) Payment & Fraud Screening
We accept the payment methods shown at checkout and may use third-party payment processors. You authorize us and our processors to verify payment information, perform fraud checks, and charge your payment method for the total order amount. Chargebacks filed without first contacting us to resolve an issue may be contested.
 
8) Shipping, Delivery & Risk of Loss

• Processing & Transit: Estimated processing and shipping times are shown at checkout and may vary.

• Risk & Title: Risk of loss passes to you upon our delivery of products to the carrier. Title transfers to you when we receive full payment and ship the order.

• Address Accuracy: You are responsible for providing a complete and accurate shipping address. We are not liable for deliveries lost due to incorrect addresses or unclaimed packages.

• Partial Shipments: We may split orders into multiple shipments.

 
9) International Orders & Customs
International customers are responsible for any customs duties, import taxes, brokerage fees, and compliance with local laws. We are not responsible for delays caused by customs.
 
10) Returns, Exchanges & Refunds (Products Only)
Please also review our Return Policy (if posted on the Site). Unless otherwise stated there, the following default rules apply:

• Window: You may request a return within 14 days of delivery.

• Condition: Items must be unused, unopened, and in original packaging with all seals intact.

• Hygiene Items: Due to health and safety standards, opened or used personal-care products (e.g., hair oils, shampoos, any product that contacts skin/scalp) are final sale and not eligible for return unless defective.

• Defective/Damaged: Report manufacturing defects or shipping damage within 7 days of delivery with clear photos; we’ll replace or refund at our discretion.

• Fees: Original shipping fees are non-refundable; return shipping is your responsibility unless we made an error. We may charge a reasonable restocking fee for non-defective returns.

• Process: Contact us at info.josstudios@gmail.com for an RMA and instructions. Returns without authorization may be refused.

11) Product Safety & Use (Cosmetic/Personal-Care Disclaimer)
Our products are for external use only. Discontinue use if irritation occurs. Perform a patch test before full use, especially if you have allergies or sensitive skin/scalp. Avoid contact with eyes; if contact occurs, rinse thoroughly. Keep out of reach of children. Our products are not intended to diagnose, treat, cure, or prevent any disease and do not constitute medical advice. Consult a physician if you are pregnant, nursing, have a medical condition, or are taking medications.
 
12) Promotions, Bundles, Discounts & Gift Cards
Promotions are limited-time, while supplies last, and may not be combined unless explicitly stated. Promotional items may be final sale. Gift cards (if offered) are non-refundable and subject to terms provided at purchase and applicable law.
 
13) Intellectual Property
All content on the Site—including text, graphics, logos, product names, images, and software—is the property of JOS Studios or its licensors and is protected by intellectual-property laws. You may not copy, reproduce, modify, distribute, or create derivative works without our prior written consent.
 
14) User Reviews & Submissions
If you post reviews, photos, or other content, you grant us a non-exclusive, royalty-free, worldwide license to use, reproduce, and display that content for marketing and operational purposes. Do not submit content that is unlawful, infringing, misleading, or harmful.
 
15) Prohibited Activities
You agree not to use the Site for unlawful purposes; infringe IP rights; submit false information; upload malware; scrape or crawl the Site; interfere with security features; or engage in fraudulent purchasing (including resale quantities without permission).
 
16) Third-Party Links & Tools
We may offer links to third-party sites or tools. They are provided “as is” and “as available.” We are not responsible for their content, policies, or practices. Use at your own risk and review their terms.
 
17) Errors, Inaccuracies & Omissions
Information on the Site may contain typographical errors or inaccuracies (including product descriptions, pricing, shipping charges, transit times, and availability). We may correct errors and update information at any time without prior notice, including after you submit an order.
 
18) Disclaimer of Warranties
Except as expressly stated in writing, products and the Site are provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, title, and non-infringement. Your statutory rights are not affected where they cannot be excluded.
 
19) Limitation of Liability
To the fullest extent permitted by law, JOS Studios and its officers, employees, agents, and suppliers will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, or data, arising out of or related to your use of the Site or purchase/use of products. Our total liability for any claim relating to a product will not exceed the amount you paid for that product.
 
20) Indemnification
You agree to indemnify and hold harmless JOS Studios and our affiliates, officers, directors, employees, and agents from any claim, loss, or demand (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site, or your violation of any law or third-party rights.
 
21) Force Majeure
We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, labor disputes, supply chain disruptions, carrier delays, epidemics, or governmental actions.
 
22) Governing Law & Venue
These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law rules. You agree to the exclusive jurisdiction of the courts located in Ontario, Canada for any dispute not subject to mandatory consumer-protection venue rules.
 
23) Electronic Communications & Notices
You consent to receive communications from us electronically (e.g., email, Site notices) and agree that such communications satisfy legal requirements for written communications.
 
24) Severability & No Waiver
If any provision is found invalid or unenforceable, the remaining provisions remain in full force. Our failure to enforce any right is not a waiver of that right.
 
25) Assignment
You may not assign your rights or obligations under these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, or sale of assets.
 
26) Changes to These Terms
We may update these Terms from time to time by posting the revised version on this page with a new “Last updated” date. Continued use of the Site after changes constitutes acceptance.
